DVRupgrade is providing a service to make your life as an upgrader easier. We do not assume the risks you may take by upgrading the unit yourself, and opening your unit will void the 90-day manufacturer's warranty. If you are not
comfortable with the steps involved to install your do-it-yourself kit, please consider our professional installation services; we will install any kit for an additional fee, plus the return-shipping of your unit.
DVRupgrade drive kits include a six-month warranty. If you experience
a drive failure during the warranty period, we would be happy to repair/replace
your drive kit at no charge, other than shipping, within six-months of
your original purchase date. If you experience a failure during our warranty
period, you are eligible for support under our GetWell program; we will ship
you new drives and a return label for your old ones, as long as the transaction
is authorized on a major credit card. This is similar to what many manufacturers
call an advanced exchange program. More information on our GetWell

Kit descriptions and reported capacities are usually based upon
the most current TiVo software being present on your unit. Actual capacities
may differ slightly based upon available disk drive capacity which varies among
drive manufacturers. Kit capacities quoted on our web pages are conservative,
and in all likelihood your kit will exceed the quoted capacity. In some cases,
kit capacity may be slightly less. We attempt to ship all kits configured for
the latest version of software available for your particular make and model
of TiVo, however in some cases, a newer version may be available and your TiVo
will download it provided you are properly connected and maintain your subscription
with TiVo. Installation of our kits will not adversely affect your subscription
status with TiVo or DirecTV; even if you have a lifetime service. If TiVo or
DirecTV updates their software, enhancements installed by DVRupgrade may be
overwritten and require reinstallation or reconfiguration (to date, no software
update from TiVo has affected our capacity upgrade kits). Should this occur,
DVRupgrade will attempt to provide services to restore the software for a nominal
charge.
Any un-upgraded TiVo DVR purchased from us is covered by a 90-day factory warranty provided directly by the manufacturer. Any upgraded TiVo DVR purchased from us is covered by a one-year parts warranty and a six month parts and labor warranty.
A note about HD TiVo and TiVo Premiere DVRs: These units are designed
to contain only one internal hard drive and we offer upgraded units, as well
as upgrade kits which contain drives larger than the "stock" drives
included with your unit. If you purchase an upgraded unit or an internal upgrade
kit for your unit, you will not be able to use any external drive upgrade kit
without making software modifications to your upgraded unit. For a nominal fee,
DVRupgrade will pair any internal hard drive with an external drive, enabling
you to use a larger internal drive with an external.
Recertifications performed by DVRupgrade are warranted for 90-days, assuming the drive is provided directly by DVRupgrade. If you are sending a user-supplied drive for a recertification, we cannot offer you any warranty as we have no control of the hardware you provide or its quality and reliability.
TiVo upgrade kits which utilize hard drives "pulled" from new
TiVo units that we upgraded or are designated as kits which utilize "recertified"
drives, are indicated as such on our web site. These kits are covered by the
same six-month DVRupgrade warranty described above, however these drives contain
NO manufacturer warranty.
We are committed to keeping you as a satisfied customer however,
if you wish to return a DVRupgrade product (except as specified below) for a
refund you may do so within 30-days of your initial purchase. There is a 15%
restocking charge on all items, either received or currently on order. If "free
shipping" has been selected, actual shipping charges for the items shipped
may also be assesssed. All items must be returned in their original packaging
and if any items are damaged or missing, additional charges will apply. If you
are interested in returning an item, please contact
us and we will send you a return authorization number and instructions.
Returns will not be honored on kits and upgraded units which have been damaged
due to tampering with either the hardware or software we've pre-configured.
Software products are not eligible for refunds or exchanges.
NO EXCEPTIONS. If you purchase the incorrect software version, we will not issue
a refund or provide any additional version. Please be sure you select the correct
software BEFORE you purchase. If you purchase software and, within 30 days,
decide that you would prefer to order a complete hard drive upgrade kit, we
will issue a credit of 50% credit toward the cost of the hard drive kit, provided
that the hard drive kit is for the same TiVo model as the software purchased.
InstantCake is an easy-to-use low cost alternative to purchasing one of our pre-built and simple-to-install TiVo upgrade kits. Although the technical knowlege required to use InstantCake is relatively minimal, you must have a working PC
with two IDE interfaces, and be comfortable connecting standard IDE drives to your computer so that InstantCake may be properly installed. You must also be capable of configuring your CD-ROM or DVD-ROM as a bootable device for the InstantCake CD.
InstantCake has been tested on a variety of PC's and should work on most commonly-used systems. Your PC does not need to be particularly fast or special in any way. We cannot guarantee that this bootable CD-product will work on your system,
and if this is something you are concerned about, please consider our kits or professional installation services.
DVRupgrade kit warranties do not apply to remote software installations
or recertification/network bundle upgrades however they do apply to complete
kits purchased from DVRupgrade whether self-installed or professionally installed.
The following limitations apply to all warranties and to all products
and services provided by DVRupgrade:
All warranties are limited and do not cover, among other things,
accidental damage, misuse, improper care or alteration, or acts of God, such
as lightning strikes. Drive warranties do not cover mishandling of hard drives.
All warranties commence on the purchase date and are not renewed if service
is provided (or if a product is replaced) during the warranty period. DVR units
(including DirecTV/TiVo units) are covered under the same terms as the limited
warranty included with the unit, but the length of the warranty is as stated
above. For a problem to be covered under warranty, DVRupgrade must receive and
verify the covered problem within the warranty period or, if a problem arises
immediately prior to the end of the warranty period, DVRupgrade may, in its
sole and absolute discretion, extend a warranty by a short period to enable
a product to be shipped to DVRupgrade for repair. If a problem is covered under
warranty, DVRupgrade will pay shipping charges from us back to you (via surface
transportation) within the continental United States. Customers outside of this
region will be required to pay all shipping charges (to and from DVRupgrade)
in the event of a problem, even if the problem is covered under warranty. DVRupgrade
is not responsible for any data on your component or on your component's hard
drives, and warranty coverage does not include saving data. DVRupgrade makes
no warranty or guarantee whatsoever relating to data or data recovery. DVRupgrade
also makes no warranty about the future usability of units, upgraded or otherwise.
Software updates, changes in broadcast formats can affect the way your DVR performs
and DVRupgrade makes nor representation or warranty regarding the impact of
these changes on your DVR performs or will perform. DVRupgrade also makes no
representation or warranty regarding the continued existence (or loss) of features
now or in the future.
THIS WARRANTY AND THE REMEDIES SET FORTH ABOVE ARE EXCLUSIVE AND IN LIEU OF
ALL OTHERS, WHETHER ORAL OR WRITTEN, EXPRESSED, IMPLIED OR STATUTORY. DVRUPGRADE
SPECIFICALLY DISCLAIMS TO THE MAXIMUM EXTENT PERMITTED BY LAW ANY AND ALL IMPLIED
WARRANTIES OR CONDITIONS AS TO THE PRODUCTS OR ANY OTHER MATTER WHATSOEVER.
IN PARTICULAR, BUT WITHOUT LIMITATION, DVRUPGRADE SPECIFICALLY DISCLAIMS ANY
AND ALL IMPLIED WARRANTIES OR CONDITIONS OF SATISFACTORY QUALITY, MERCHANTABILITY,
FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT OF THIRD PARTY RIGHTS
OR ANY OTHER WARRANTY ARISING FROM A COURSE OF DEALING OR USAGE OF TRADE. THIS
LIMITED WARRANTY DOES NOT APPLY TO, AND DVRUPGRADE MAKES NO WARRANTY WITH REGARD
TO, ANY PRODUCT ("COVERED PRODUCT") OR OTHER COMPONENT ORIGINALLY
SOLD AS AN INTEGRATED COMPONENT OF A SYSTEM NOT SUPPLIED BY DVRUPGRADE. DVRUPGRADE
IS NOT RESPONSIBLE OR LIABLE FOR ANY INDIRECT, UNFORSEEABLE, SPECIAL, INCIDENTAL
OR CONSEQUENTIAL DAMAGES HOWEVER CAUSED AND WHETHER OR NOT DVRUPGRADE WAS ADVISED
OF THE POSSIBILITY OF SUCH DAMAGES, INCLUDING BUT NOT LIMITED TO, COSTS OF PROCUREMENT
OF SUBSTITUTE GOODS, LOSS OF DATA OR PROGRAMS, LOST PROFITS, DOWNTIME, GOODWILL,
DAMAGE OR REPLACEMENT OF EQUIPMENT AND PROPERTY, AND ANY COSTS OF RECOVERING,
PROGRAMMING OR REPRODUCING ANY PROGRAM OR DATA STORED IN OR USED WITH DVRUPGRADE
PRODUCTS OR ANY OTHER DAMAGES ARISING OUT OF THE PURCHASE, USE OR PERFORMANCE
OF THE COVERED PRODUCT. DVRupgrade is not, and cannot be, responsible for any
losses or damages arising out of any loss of, or any inability to access, data
as a result from the failure of a Covered Product. The allocation of risk under
this limitation of liability is reflected in the purchase price of the Covered
Product.
